Live money in California is a legal event. The table is the packet counsel walks. Status “required” is not a claim that GigRentals already holds the paper — it is the list we will not skip. Open-source notices for the software are at the bottom and in NOTICE.md in the repo.

California LLC

Required before first dollar

GigRentals LLC. We do not take title. We do not hold out as a rental-car agency on these Terms.

Secretary of State + Statement of Information

City business license

Required in each city we operate (SF first)

A marketplace still needs a local business license. Not a taxi medallion.

Treasurer / tax collector of that city

PVSP / surplus-lines brokerage

Required before a live binder is sold

We are not the named insured. Per-trip binders under CA Ins. Code § 11580.24. Surplus-lines placement is the partner’s license, not a GigRentals master book.

CDI + MGA / surplus-lines partner (Lula, Tint, or ABI)

Transient occupancy / vehicle-share tax

Off until TAX_COLLECTION_ENABLED and a city BPS table

Charging the wrong TOT is worse than charging none in demo. Default bps is 0.

City/county (varies). Counsel loads TAX_CITY_BPS_JSON.

CDTFA seller's permit

Only if we collect sales/TOT

Turn on with tax collection, not before.

California Department of Tax and Fee Administration

Information returns

Stripe Connect files 1099-K; we may also issue 1099-NEC

2026 factors: NEC $600, 1099-K $2,500 gross through the platform unless Congress freezes the old test.

IRS + CA FTB copies as required

FCRA / investigative consumer report

Required before Checkr MVR is live

Identity (Stripe Identity / Jumio) is not an FCRA report. MVR/background is. We must give a notice and a chance to dispute before a decline that relies on the report.

Checkr (or successor) + adverse-action process

E-SIGN + CA UETA

In product now

Electronic records of listing, owner-program, driver-lease, and booking contracts.

Typed legal name + initials + checkbox

CPRA / CalOPPA

Notice, privacy policy, request path

We do not sell or share personal information for cross-context behavioral advertising. GPC is treated as an opt-out of sale/share and of optional device telemetry.

privacy@gigrentals.com and /privacy/request

Stripe Connect / card network

Required for live money

The desk never stores balances or PAN. Hosts and lessees complete Stripe's own KYC.

Stripe services agreement + Connected Account agreement

TCP / rental-car permit

Not applied for — we are not a rental agency

If counsel later says a city treats P2P hire of a vehicle as a rental business, we pause that city. We do not dispatch TNC trips (no CPUC TNC permit).

CPU C / city rental permits
