Required disclosures

Effective 2026-08-19. Templates — not legal, tax, or insurance advice.

GigRentals materials are product templates for an application process. They are not legal, tax, or insurance advice. A California attorney and a licensed broker must review any live program. Quotes are estimates. Applications are not offers. Inspection, underwriting, match, and countersignature are required before any vehicle changes hands.

1. Marketplace, not an agency

GigRentals LLC matches hosts and lessees. We do not take title, do not employ either party, and do not dispatch Uber/Lyft/DoorDash trips or set those fares. An application, quote, or rank is not an offer. Keys move only after inspection, tracker install, countersignature, and payment. Full owner rules: /legal. Terms: /tos.

2. How money is collected

Cards and bank accounts are Stripe objects. A $249 (default) deposit hold on the lessee, seat rent in advance, host pay in arrears net of the protection take (15% Standard / 25% Plus). The admin desk cannot see balances or last-fours. Refunds and disputes happen in Stripe. We never ask you to wire the LLC outside Stripe for a live seat.

3. Tax

  • Hosts and lessees are independent. We do not withhold income tax except legally required backup withholding.
  • 2026: 1099-NEC if we pay you $600+ as nonemployee compensation; 1099-K via Stripe if gross through the platform meets the $2,500 (phase-in) test.
  • Demo 1099s are stamped VOID. Live filing needs a W-9 / TIN.
  • City vehicle-share / TOT is 0 bps until counsel loads a table and TAX_COLLECTION_ENABLED=true.
  • We do not prepare Schedule E, Schedule C, or mileage logs.

Worksheet: /tax.

4. Insurance periods

Period 1 (off-rental): owner policy; we have zero liability. Period 2 (possession, gig app off): a per-trip PVSP binder (CA Ins. Code § 11580.24) names the driver as insured and the owner as additional insured / loss payee. We are the intermediary, not the policyholder. Period 3 (gig app on): that company’s policy is primary. Claims file with the InsurTech carrier — not our ledger.

5. Electronic signatures

Typing your legal name and initials, with the checkbox, is your signature under the federal E-SIGN Act and the California Uniform Electronic Transactions Act. You can download a copy from your account. Venue: California.

6. Background checks (FCRA)

Before keys, lessees complete identity (Stripe Identity or Jumio) and a motor-vehicle record through Checkr or a successor. If we take an adverse action based on a consumer report, we will give the FCRA notices and a chance to dispute with the agency. Identity selfie match is not itself an FCRA report.

7. Data

Privacy, cookies, and CPRA requests. We do not sell personal information.

8. Licenses we do and do not hold

See /licenses. CPUC TNC and TCP permits are not in this product because we do not carry passengers as a carrier and we do not hold out as a rental counter.
